Terms of Service for Snow Flake

This Terms of Service (the “Terms”) is a legally binding agreement between you (“User” or “you”) and Snow Flake (“Service,” “Bot,” “we,” “our,” or “us”). By inviting, accessing, or using the Bot on Discord, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By using Snow Flake, you represent that you have read, understood, and agree to these Terms and any additional guidelines, policies, or rules referenced herein. Your use of the Service constitutes your acceptance and consent to be bound by these Terms.

2. Description of the Service

Snow Flake is a full-featured Discord bot designed to provide moderation, entertainment, and interactive utilities for your Discord community. It leverages Discord’s API and is governed both by these Terms and by Discord’s Terms of Service. We reserve the right to add, modify, or remove features as needed.

3. Eligibility and Account Requirements

• Age Requirement: You must be at least 13 years of age (or the minimum age required by your local laws) to use Snow Flake.
• User Account: If you interact with account-based features or invite Snow Flake to servers, you agree to provide accurate and current information.
• Compliance: You warrant that you will comply with all applicable local, state, national, and international laws or regulations when using our Service.

4. License and Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use Snow Flake solely for personal and non-commercial purposes within Discord. Any unauthorized use, including duplicating, modifying, selling, or otherwise exploiting the Service, is strictly prohibited.

Any failure to meet these obligations may result in the suspension or termination of your access to Snow Flake.

6. User Content and Data

• Content Ownership: You retain ownership of any content or data you submit during your interaction with Snow Flake.
• License to Use: By submitting content, you grant us a royalty-free, non‑exclusive, transferable (in some cases), and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content solely for the purpose of operating and promoting the Service.
• Data Privacy: We adhere to a Privacy Policy that governs how your personal data is collected, stored, and protected. Please review it to understand your rights regarding your information.

7. Intellectual Property Rights

All intellectual property rights in and to Snow Flake (including software code, design elements, documentation, and related content) are owned by us or our licensors. 8. Disclaimers and Limitation of Liability

• No Warranty: Snow Flake is provided on an “as is” and “as available” basis without warranties of any kind—express, implied, or statutory. While we strive for accuracy and reliability, we do not warrant that the Bot will be error‑free or uninterrupted.
• Limitation of Liability: In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless the service providers, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of Snow Flake or any violation of these Terms.

10. Modifications and Termination

• Modifications: We reserve the right to modify or update these Terms at any time. Any changes will be posted with an updated revision date. Continued use of Snow Flake after any modifications constitutes your acceptance of the new Terms.
• Termination: We may, at our sole discretion, suspend or terminate your access to Snow Flake at any time and for any reason (or no reason). In the event of termination, your right to use the Service ceases immediately.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or your use of the Service will be resolved exclusively through binding arbitration, in accordance with the rules set forth therein. By using the Service, you agree to submit to such dispute resolution procedures.

12. Miscellaneous

• Entire Agreement: These Terms, along with any policies referenced herein, constitute the entire agreement between you and us regarding the subject matter hereof.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
• Waiver: No waiver of any provision of these Terms will be deemed to be a further or continuing waiver of such provision or any other provision.
